Individuals with low self-efficacy are more apt to looking as difficult tasks as intimidating and do not believe they that are capable of achieving personal success. Overall, self-efficacy plays an important role in influencing the tasks that people perform and how well they perform them. The most important factor that is impacting through self-efficacy is persistence. This is found important because the higher the person perceives themselves on the scale, the more persistent that they will be with performing a complex task. Analysis and Recommendations as per Self Efficacy model Self-efficacy is something that is important in any organization. However, it is important at Texas Roadhouse to hire individuals who have a High level of self-efficacy so that employee perceives themselves capable of achieving many complex tasks. This could prove to be an issue within the organization because individuals could become bored or feel not challenged by the tasks designated in their position, which could lead to frustration for the employees and employer. Hence, Challenging tasks should be given to such individuals. 1) The individuals with moderate level of self-efficacy provides opportunity for the organization to designate tasks to that are challenging but also still attainable. It is good to hire large no. of employees in this category. There were three individuals who scored close to the lower end of the self-efficacy scale. 2) The individuals with low self-efficacy can pose a problem for Texas Roadhouse as they might hinder the productivity and success of the organization. Hence, in order to ensure more confident and driven individuals, Texas Roadhouse could moderately delegate more difficult tasks to these individuals in order to boost their confidence and the way they perceive themselves. Also, they could provide more positive feedback in their jobs and reinforce that the individual is doing well at their job. 2) Leader-Member Exchange The leader-member exchange (LMX) is a model that suggests that leaders develop different relationships with each of their subordinates through a series of work-related transactions. There are two important groups to consider that a subordinate may fall under depending on which phase they fit into. The in group is defined as a low number of subordinates with high LMX relationships. The second group is known as the out group in which the number of subordinates is large and contains relatively low level LMX relationships. Employees who find themselves in the out-group are likely to face high job turnover. This should be important to all management because high turnover is a very large investment for the organization. The level of LMX has a significant relationship to subordinates satisfaction with their manager. Employees with low-quality LMX are more likely to become dissatisfied, less motivated, and more prone to quitting. Whereas employees with high level LMX are likely to be satisfied with their work, more motivated, and committed to staying and contributing to the organization. LMX has three critical components which are mutual affection, contribution to work activities, and professional respect. When a subordinate has high mutual affection for a superior, the subordinate likes the superior as a person and will often come to the superior’s defense if attacked. High contribution to work activities comes into play when a subordinate goes above and beyond their job description to help the superior out. High Professional Respect is when the superior admires the subordinate’s knowledge and competence of the job. Analysis and Recommendation as per LMX 1) The Texas Roadhouse management does take steps to increase the mutual affection score of its staff else they will likely to enter the realm of the out group which could potentially lead to the employee leaving the organization because Why stay at an organization if you’re not happy with your manager? 2) One way management can increase the mutual affection is to take a more active role and listen to the complaints of the employees and to take the time to establish supportive and trusting relationships with the employees. 3) Another suggestion might be to engage the staff in team building activities and icebreakers. We can conclude that the superiors and managers of Texas Roadhouse are not providing proper support to their staff and needs to make a drastic change soon because the organization as a whole could be affected. 4) Some possible solutions include taking the time to reassess what kind of support is needed for staff. One way to do this is anonymous comment cards. Have all the employees fill out comment cards anonymously and identify specific instances where an employee failed to receive support. This must be down anonymously by the employer because the employee might be unwilling to respond for fear of termination. 5) The manager may have a tendency to interact with other employees in an unprofessional manner. The manager can decrease this perception by keeping to policy or by adjusting his/her interactions in front of employees. 6) Management needs to do a better job of developing better relationships with its employees. Some improvement strategies include the use of assertive communication, appropriate communication openness, and constructive feedback with all of the subordinates. Job Characteristics Model The job characteristics model has to do with the idea of increasing the amounts of five job characteristics: skill variety, task identity, task significance, autonomy and feedback in a job. Skill variety can be defined as the degree to which a job requires an assortment of skills in order for an employee to carry out the task at hand. Task identity is the extent to which a job requires an employee to complete a task from beginning to end with a visible, tangible outcome. Task significance is the extent to which an employee perceives the job as having an impact on the lives of other individuals, if it makes a difference in society, within or outside of the organization. Autonomy is the level to which a job provides empowerment and discretion to an employee by choosing their own way to complete and schedule a task. Job feedback is the clear information about how effective an employee’s performance is. The different levels of these five job characteristics affect three important psychological states. The first, to experience meaningfulness of the tasks performed, second, to experience personal responsibility for results of the task at hand, and last is the knowledge of the results of task performance. If all three psychological states are positive, strong work motivation based on self-generated rewards is triggered. If they are in the negative zone, meaning the job is not meaningful, lacks responsibility or feedback, the job is incomplete, which does not strongly motivate an employee. This model can be related to Texas Roadhouse since it looks into how well an employee has the opportunity to be motivated to work in the restaurant. It highlights the areas that need work in the restaurant and what the employees enjoy or dislike about working there. It also demonstrates which employees are content with working there for a while and which view it as a stepping stone towards another opp ortunity that has not yet befallen upon them. Analysis and Recommendations as per Job Characteristic Model 1) The model demonstrates a need for change in the structure of Texas Roadhouse in order to increase their employee’s motivation to continue their work there. Generally, there are two main approaches recommended to superiors for designing/redesigning jobs which are vertical loading and the formation of natural work teams. Vertical loading is when tasks that were considered reserved for management level staff are delegated to all employees. It includes the power to set schedules, decide work methods, breaks, and seek solutions to their own problems. Natural work teams combines individual jobs into a unit which are logical and meaningful including geographic location, types of business, organizational, alphabetical or numerical, customer groups. If Texas Roadhouse implemented vertical loading into their structure and gave their employees the opportunity to decide their own breaks and more flexible schedules, it could aid in their desire to maintain their positions at the restaurant. Most of the employees are pretty satisfied with the way things are run at Texas Roadhouse, however, according to the data, one of the biggest issues the employees have with Texas Roadhouse is the lack of variety, out of twenty surveys; eleven scored less than a four on the scale. The employees also feel that they do not have the opportunity to see projects through to completion which affects their task identity characteristic. This can be fixed with a simple solution, which is to allow employees to complete a task before assigning them another. Goal Setting Model Goal setting is a very integral part of any job. Whether you are attempting to better yourself or complete a project, setting goals is one of the most helpful tools to assist you throughout the process. Goal setting can definitely help a business such as Texas Roadhouse in raising their standards for employees which will end up helping the bottom line. The goal setting model that we used for our survey seems to have a big impact on job performance. According to the model, if employees felt good about the goals they set, they were better at their jobs. Five essential pieces must come together in order for the managers to gain benefits of a goal setting program. The first piece is that the person must be knowledgeable about the topic of the specified goal and have the sufficient capacity to attain the goal. The second step is that the person must be committed to the goal, especially if the goal is difficult. The third step is that people need feedback on their goals. According to the text, employees will raise their performance because they are afraid they will have past performance. The forth step is that complex tasks must be broken up into simpler more short term goals so that the goals can be attained. It is stated in the text that employees are more responsive when they know about their progress. The fifth and final piece is to have a situation constraint. One of the most important aspects of a leader is to ensure that employees have the resources to attain their goals and to help eliminate any troubles that may lie in the way. Now to discuss some of the benefits that goal setting can have on performance. One of the consequences of goal setting is that it motivates individuals to achieve high performance. Some of the benefits stem from developing difficult goals. When it comes to Texas Roadhouse, such goal setting can be setting goals for a certain dollar amount each table waited on per person. The benefits can be such as encouraging people to develop action plans to reach a goal, focusing people’s attention on goal-relevant action, and encouraging people to develop action plans to reach these goals. Having such goal setting systems in place, you will have to be able to adequately reward your employees. Such reward systems could be like the high-performance work system which is used to describe a well-established method of motivation with new technology that links pay and performance. This isn’t very easy to do, especially when considering the many factors. Such factors could ask questions such as, do you reward individually or as a team. Analysis and Recommendation as per Goal Setting Model Going through a few of the steps that go into goal setting and based on the results provided from the study, we have developed some recommendations for the restaurant. The first recommendation is to put groups of waiters and hostesses into teams in order to create an atmosphere of meritocracy. When there are teams, it’s easier to have tasks done and team members will have the mentality of â€Å"if I scratch your back you scratch mine.† Going along with more of the recommendations through the analysis of the process of effective goal setting, a proper high performance work reward system must be put into place in order to motivate employees. Our recommendation for the work reward system is a system that rewards waitresses on the amount of money per person that they serve. So for example if a team earns on average $15 per customer and another team earns $20 per customer, we reward the team with the $20 per customer with a bonus on top of their normal tips. To further develop their goals, we can get input for the teams on how they would like to improve the model because it is stated that the more input the employees feel like they are giving, the more they would buy into the program. To improve on that, we would also make the goals a little bit more challenging. For example we could expect a higher dollar amount per customer over last month. For example a ten percent increase could be viable. The last of our recommendations is to give each employee a step by step plan on how to achieve their goals and to give them a monthly review. These recommendations would help Texas Roadhouse by improving their trust between one another, their individual and team goals by giving them more input which leads to more buy-in and lastly, it helps them raise their revenue by setting higher goals for each customer. Static electricity was discovered in 600 B.C., but it was not until the mid 1700's when energy storage properties were discovered. 'With the discovery of the first Leyden jar, it was referred to as a condenser because electricity was thought of as a fluid which could condense. The Lehden jar is a glass partially filled with water that has a wire inserted through the top of an insulating stopper (cork). When the wire is charged by static electricity, it holds the charge until the wire comes into contact with a conductor which will discharge the glass. It was roughly one hundred years later when Michael Faraday discovered a variable capacitor. He did this by measuring the varying capacitance of different dielectrics on capacitor.'(4) When the first aluminum capacitor was discovered, some thirty years after Faraday's work, the SI unit used measuring capacitance was named a farad (F) in his honor. 1F = 1 C / V In words: one Farad is equal to one Coulomb per Volt Since the farad is a large unit of capacitance, most capacitors have units of picofarads (pF) or nanofarads (nF). To this day only one type of capacitor has the ability to store enough energy to warrant measurements using a farad as the standard unit, and this is the super capacitor. A capacitor consists of two conducting surfaces separated by an insulator (dielectric). The value of capacitance depends not only on the geometry of the capacitor, but the dielectric as well. You can see that when the electodes are switched, the resistance again goes to zero when the capacitor is fully charged. AC current is allowed to pass through the conductor continuously because it works similiar to the way the probes are switching, so the current is allowed continuos flow. The main function of a capacitor is for it to store energy and to act as a filter, passing current (AC) and blocking current (DC).

Proposition 8

Do you believe society should have the ability to determine if same sex partners should marry? Determining your soul partners should be a privilege for all, such as homosexuals, lesbians, gays, bisexuals etc. and not society. Homosexuals are not abnormal humans, so there is no reason to treat them any different, after all they are citizens who oblige to the same jurisdictions. In the brief article, 8 Is Not Hate: The Meaning of a proposition by Jennifer Roback Morse, Morse explains how marriage is a gender-based institution that attaches mothers and fathers to each other and to their children, but I disagree with her theory of marriage.I believe marriage is based on the love, trust, and the ability to provide for one another. If you were brought into this world as a homosexual then who are you to deny marriage to same sex partners, because although you deny marriage to same sex couples they’re not going to change their beliefs and values just because society does not accept th em for who they are. Same sex couples should have the ability to choose their own spouses, without having to deal with ignorant bigots such as those who won’t accept others preferences, because of religious beliefs and values morals.If homosexuals have the same responsibility, consequences, and obligations as straight people then there is no reason to keep marriage away from same sex partner. Being homophobic is having fear of or contempt for lesbians and gays. Proposition 8 is seen as a discriminating proposition towards to gays and lesbians, because same sex couples are judged by almost all who don’t accept their sexual desires.Not only are homosexuals judged but they are also verbally assaulted, physically harmed, and even threatened by homophobic bullies who have hate against same sex couples. I experienced this discrimination and bullying three months ago. I have a co-worker whose name is Rene and that is gay and I got to be good friends with him over the summer. He described how he would go to school and he would have students call him names, and at times physically harm him because of his sexual preference.I asked him when he realized he was gay and he told me he always liked girl accessory for some reason. It’s like if he was born gay so what can he do about it? He is a very confident young man and explained how he wants to marry his boyfriend, so why can’t he choose who to marry his soul mate. I don’t believe anyone should have the ability to decide on other people’s ability to marry, only god can decide that and apparently he doesn’t mind because he put homosexuals into this world so why deny the love they share for each other.If gays/lesbians don’t have ability to decide if straight people could get married then I don’t believe straights should decide who homosexuals should marry. Proposition 8 is denying same-sex partners to marry through civil law then there should be no implementation s on the religious side. Morse also describes how, â€Å"The court changed the jurisprudence of sexual orientation discrimination cases, giving same sex-couples the highest level of protection.This means that in contest between religious liberty and sexual orientation discrimination, religious liberty would almost always lose. † (p. 83) Morse is describing how the court ruled over religion because in reality same-sex couples that get married through civil law have nothing to do with religion. If same-sex partners do not get married under religion, then there is no reason for people who believe in religion and marriage as only heterosexual couples to decide if homosexuals have the ability to marry.In the bill of right of the United States the first amendment states how congress shall make no law respecting an establishment of religion, or prohibiting free exercise thereof. If being a homosexual is a free exercise and no law Is made to respect religion, then there shouldnâ€⠄¢t be a proposition banning the same- sex marriage, because it is only in the bill of rights to do as you please as long as it’s in the jurisdiction bounds. . Our society is not as tolerant as it used to be, but that doesn’t mean it should be tolerant towards certain issues such as the one on proposition 8.Homosexuals will not stop fighting this issue because marriage is a part of life and if religion does not have anything to do with this issue because they are getting married through the civil law, then let them live just like they let us live. Voting no on proposition eight is what everyone should do not only because it’s the right thing to do but also because in the end they will not turn straight just because society does not let them marry. Same-sex couples will not stop fighting this issue that has to do with their realties and not ours, so let them be.

I chose this particular car because with the FREE extended warranty and the rebates on this car it turned out to be a cheaper car than the G8 but also a better car. Honestly the marketing on this car did not influence my opinion at all. I never thought about this specific car until at the dealership that day. When I purchased this car Chevrolet has awesome rebates and interest on their new vehicles. After my purchase I stared seeing, or paying attention, to the commercials on this car and I am positive I made the right decision. If I would have paid attention to the commercials on this car it would have been the car I chose anyway.

Introduction For many years in the United States the minimum wage has not aligned with the cost of living. Low wage workers typically earn the minimum wage and cannot sustain themselves due to the constant rise of housing, food, and health care. The bourgeoisie manipulates the proletariat through exploitation with a subsistent wage that rarely increases. In this essay, I aim to demonstrate that the elite cause a class conflict to keep the bourgeoisie in power to maintain a hegemony over the lower class. II. The Elite Perspective In a New York Times article titled, Higher Minimum Wage May Have Losers, Noam Scheiber highlights that many cities and states are considering raising the minimum wage, but some economists and business owners warn that a raise may be problematic for business owners and current low wage workers. At the annual American Economic Association, Economics professor John Horton Of New York University delivered an essay concerning an experiment he did regarding raising the minimum wage. Using an online platform, employees post jobs anonymously. Workers then submit an hourly wage competing for them. Scheiber states: Mr. Horton, working with the platform, was able to impose a minimum wage random on one-quarter of about 160,000 jobs posted over roughly a month and a half in 2013. If a worker proposed an hourly wage that was below the minimum, the platforms software asked him or her to raise the bid until it cleared the threshold. (cite) At prima facie, the experiment demonstrated that when the minimum wage increased there was little if no decline in hiring. However, the hours a worker spent on a job fell for the jobs that were lower wage before the study. In addition, Horton claimed that employers were hiring more productive works to compensate for the lost earnings from the adjusted higher wage. Consequently, the lower wage workers were less productive, according to Horton, and thus lost their jobs. He concluded that raising the minimum wage could cost low-skilled workers their jobs, as employers replace them with higher productive individuals. Additionally, some economists claim that the more productive workers that do not take the jobs from the low skilled workers will also need a pay raise, which may cause more economic issues. Furthermore, others such as Zane Tankel, chief executive of Applebees restaurant infers that higher wages will accelerate automation, which will offset costs and leave may workers jobless .[1] III. A Sociological Critique Hortons data is tailored to benefit the bourgeoisie and highlights how the individuals in elite position help maintain a hegemony over the lower class. Consequently, the proletariat is given a subsistent wage and is exploited for their labor. Marx claimed that the worker is given just enough pay to survive and have a family and children so that when the worker falters, the children can take over the subsistent wage.[2] Hortons experiment highlights how the worker is exploited with a subsistent wage. In addition, his data demonstrates that low wage workers will lose their jobs to the high output workers. This conflict between the two workers causes what Marx termed alienation. Marx defined it as: the breakdown of, the separation, from, the natural interconnection between people and their productive activities, the products they produce, the fellow workers with whom they produce those things, and with what they are potentially capable of becoming.[3] This alienation keeps individuals from achieving their full potential and keeps them in a subservient state. Scheibers article contains a comment from Applebees executive who states that forced higher wages will accelerate automation, thus more employees will lose their jobs. The inference that workers will be replaced faster by automation demonstrates that the bourgeoisie does not value the labor that the proletariat loses for a meager wage. Marxist theory states that all value comes from the labor and is therefore traceable, in capitalism, to the proletariat.[4] The bourgeoisie does not recognize this value and further exploitation of the surplus value that is extracted from the worker. Scheibers article demonstrates that Horton neglects the conflict between classes and actually helps the elite in a bias fashion. IV. Solution One may contemplate if the worker and capitalist comprehend the magnitude of the conflict between them. Marx would assume that, both the proletariat and the capitalists [bourgeoisie] have an inaccurate sense of themselves, their relationship to one another, and the way in which capitalism operates.[5] While this may be true that the average individual or business owner is unaware of this conflict and holds false consciousness, it is unlikely that Professor Horton is ignorant of these conflicts. While some are aware and have false consciousness, it is crucial that the majority of both capitalists and workers become aware or have class consciousness-the ability of a class, in particular the proletariat, to overcome false consciousness and attain an accurate understanding of the capitalist system.[6] Additionally, once this consciousness is achieved, then the workers must engage in what Marx termed praxis, or the idea that people, especially the proletariat, must take concrete action in order to overcome capitalism. This solution of praxis is extreme and workers can most likely keep some form of capitalism but demand a proper wage. The consciousness compounded with praxis can even out the conflict between the classes and articles concerning the debate over low wages would be nonexistent. V. Conclusion The article Higher Minimum Wage May Have Losers, highlights the conflict that individuals such as Horton create between the workers and capitalists. The conflict between the two creates what Marx claimed to be a loss of human potential through exploitation, alienation of surplus value, and the fact that workers work and live under a subsistent wage. William Wallace, one of Scotlands greatest national heroes to ever live, had had enough of King Edward I (Longshanks), king of Englands rule over Scotland. The patriotic Scottish outlaw organized a rebellion to stand up to Edwards rule. Wallace became a hero among the Scots but was considered a traitor by the English. Ultimately Scotland did win its freedom, but Wallaces own campaign was a failure. The main reasons for the failure of William Wallaces military campaign are: The lack of leadership on the Scottish side, the lack of cooperation among the Scottish nobles, and the fact that the Scots were greatly outnumbered, poorly trained and poorly armed. The first point that will be discussed is the lack of Scottish leadership. It would be impossible for any army to have many, if any, victories when there is no true leader to stand up and lead. Scotlands king, Alexander III, had, died after riding off a cliff during a wild storm.1 There was no heir to the Scottish throne because King Alexander III had outlived all of his children.2 Without a king, Scotland was pretty much lost. They had no direction as to what to do or when to do it. Without a king, the next in line to rule would have been the nobles. The problem with the nobles is that they were all too stubborn and proud to be ordered around by anyone, or cooperate with any of the other nobles. They would fight in their own good time and wherever they saw fit, but they would accept orders from no one.3 It was bad enough that Scotland had no king but the defiance by the nobles to lend Wallace aid did not help Wallaces campaign at all. The little leadership the Scottish rebels had was not enough. William Wallace is said to have been an excellent fighter. Unmatched in strength, speed, stamina or skill with a claymore, but despite his ability to fight, he was very inexperienced in commanding an army. The only thing he had ever led was a handful of loyal rebels on raids. The Scottish spirits were high but their courage was not enough to overcome the lack of organization.4 Thomas B. Costain says, The best fighting force in the world would be helpless if it lacked authority behind it to supply arms and food and scouting facilities to keep an eye on enemy movements.

Dean Larges

I interviewed one of my former student's who was considered to be a bully when he was in my classes as a student in 7th and 8th grade. The young man's name is Dean Larges. When Dean was in my physical education classroom I had to constantly stay on him about his behavior towards other students. He would not only verbally abuse students but on occasion would get into physical altercations with some of his classmates. Recently Dean has come back to the area as a parole officer. I asked him if he was willing to be interviewed about his past behaviors during middle school. We sat down on a few occasions and talked about his past behaviors and actions. I also talked to him about the decision to work in the courts and schools with our troubled youth. The first thing we discussed during the interview was the environment in which he grew up. Dean was raised in a normal middle class family. When he was in the 6th grade, which is the year before he attended the middle school that I work in, his parents divorced. He grew up with a brother who was four years older than him. Dean admittedly said that when his parents divorced, it was a changing point in his behavior. In his memory up to that point he did not consider himself to be a bully. He remembers being very happy while his parents were still married. He felt a lot of anger over the divorce and did not talk to either of his parents about it. He felt that the rules were different from house to house which confused him at a young age concerning rules. He feels now that his bullying increased as a way to â€Å"fill the void of not having both of his parents around†. He said during middle school most of the attention that he received from the bullying was positive from his peers. Looking back he realized that he deemed the laughing from his peers to be positive but more than likely they were just trying to appease him so he wouldn't bully them. He was fairly large for his age which made it more difficult for students to stand up to his bullying. By nature Dean was and still is very outgoing. This combined with his aggressive behavior and the anger he felt at this time was not a good combination. He had always been involved in sports and was aggressive but up until this point not overly aggressive with his classmates. He had a real problem not seeing his dad on a daily basis. He feels that he started to take this anger out on his classmates and at times his teammates in the various sports that he was playing. Many of his coaches especially in football encouraged or rewarded the aggressive behavior so in his mind they were condoning it. He felt that this was one of the reasons the behavior started to increase, as he was being rewarded for it. When he got to middle school he had more freedom and more time to act out. When Dean first came to middle school he was not in my physical education class but he was in the gym and the locker room during an hour where I also taught a class. I had to deal with him multiple times either for being too aggressive or for verbally abusing students. He was always very apologetic after the fact but continued with his behavior. He was suspended from school once or twice due to bullying/fighting in other classes during his 6th grade year. His 7th grade year he was in my class and after the start of the year his behavior was better, at least in my class. He seemed to have more issues in classrooms with female teachers. We talked about this and he said that his mom's rules were not very strict compared to his dad's so this was probably the reason for his lack of respect for female teachers. He claims that as he moved into high school his bullying behavior slowed and eventually stopped as he started to see that his parents' divorce was actually a good thing for them. Both of his parents seemed to be happier now that they were divorced. Dean felt part of it was also just growing up and seeing the effects that his bullying behaviors had on his fellow students. During our interview we discussed if his mother or father were verbally or physically aggressive or abusive. Dean said that both of his parents were very loving and not abusive at all. I do not feel that any genetic factors played much if any of a role in Dean being a bully. Dean and his older brother also had a good relationship. They played sports together and were fairly close even with the four year age difference. Dean felt that another factor at this age was that he started seeing less of his brother. His brother started driving and was playing different sports so he was not around as much as he had been. There were many sources that influenced the changes and or lack of changes in Dean's behavior. As I discussed earlier his parents' divorce had a big influence. Another factor that had influence was the changing of schools from elementary to middle school and the extra freedom that came with that. In talking to Dean he said that a big factor in changing his behavior were a few male teachers and coaches. One in particular made a strong impact on helping to stop his bullying. He said that his junior varsity football coach played a big role in teaching him how to act properly and held him to a higher standard of behavior. This particular coach was also his U.S. History teacher so he spent quite a bit of time around him. This teacher/coach helped him to understand why treating people, including classmates and teammates with respect is an important life skill. The last topic we discussed was how we can get through to young people so that we can stop the bullying. In Dean's opinion and I agree, we need to continue as adults to take the time to get to know students and understand their individual situations. Once you have a better understanding of what's happening in their lives you can figure out a better way to stop the bullying. His past behavior and the belief that he could help troubled youth turn their lives around was the main reason that he chose the career that he did.

Often a film conveys a message about a character through various film techniques. This is true in the film â€Å"In The Name of the Father†. This story is mainly about a young man who is arrested for a crime he did not commit and how a relationship between father and son deepens throughout the tragedy. The main character, Gerry Conlon, is first portrayed to the viewer as an unruly rebel but is later developed into a more docile and compliant character. No doubt Sharia has always been a notion of conflict among Muslims and Christians in Nigeria. As Islam was being introduced into northern Nigeria in the 14th century, Muslims applied the Islamic law Sharia to their everyday lifestyle as they were bound to do so being Muslims and even those Muslims who were in favor of religious freedom, they also felt it hard to cope up with the 'Sharia' law. The conflict started with the advent of British rule, when the Muslims started feeling unsecured with a disrupted legal system because Nigerian Muslims particularly those of North were not in a position to tolerate any obstruction in between them and the 'Sharia' but at the same time they were bound to follow the legal system according to which the Sharia courts came under the supervision of Europeans probably the Christians. While recognizing Sharia law and courts, the British also restricted them in several respects. The 1906 Proclamation limited the application of Sharia to Muslims and provided that these courts could not give certain punishments, such as mutilation, torture, or others which were repugnant to "natural justice and humanity." (Bello, 2000) These changes reflected at least two principles. One was a belief that certain previously existing Sharia criminal penalties were inhumane. The other was that criminal law is a public matter to be implemented by the state rather than by private or social action. Some further changes in the implementation of Sharia occurred in the Native Ordinance of 1956, officially known as the "Native Courts Law of Northern Nigeria, No. 6 of 1956." (Bello, 2000) This provided for appeals from the Sharia courts to courts of appeal that reflected a more British understanding of justice, and the Ordinance provoked disagreement with the traditional emirs, who objected to this limit on Sharia law. In an attempt to pacify the emirs, the British then established Sharia Courts of Appeal, which were meant to protect Islamic law from excessive encroachhment through appeal to English courts. (Bello, 2000) Though well maintained, these courts were looked after by Europeans and in line with colonial policy, the British established a Muslim court of appeal in 1956, which was empowered to deal with matters of Muslim personal law only. Left Sided Spastic Hemiplegia | Case Study Intervention Analysis Background Jane Walters is a five year old girl and has a diagnosis of left sided spastic hemiplegia, a form of Cerebral Palsy. Jane has two older sisters who attend horse riding lessons at their local stables. Jane has recently expressed an interest in joining them to her parents. However her parents are worried that because of her diagnosis she will not be able to keep up with her siblings. Jane is very aware of her condition, and has recently lost confidence, asking her parents why she is different from other children her age. Diagnosis Cerebral Palsy (CP) refers to non-progressive conditions characterised by impaired voluntary movement or posture, and resulting from prenatal developmental malformations or postnatal CNS damage (Reed, 2013, pp. 38-47). According to the National Institute of Neurological Disorders and Stroke (2008), it is highly likely that a child with CP will have other medical disorders such as; cognitive impairments, seizures, delayed growth and development. Spastic syndromes such as Jane’s occur in more than 70 percent of CP cases. Spastic hemiplegia is a type of CP that typically affects the body down one side. The spasticity creates a state of resistance against any range of motion; this resistance ultimately increases with increasing speed of that movement (Reed, 2013, pp. 38-47). Children like Jane with spastic hemiplegia will generally walk later than other children and will tend to walk on their tiptoes because often they will suffer from high heel tendons. Often the arm and leg on the child’s affected side are shorter and thinner (National Institute of Neurological Disorders and Stroke 2008). Impact of Right Hemisphere Brain Damage- Jane has left sided spastic hemiplegia, indicating that damage to the brain has occurred in the right hemisphere. The primary cause of CP is damage to white matter of the brain this is often caused by abnormal brain development. This can be caused by a bleed on the brain, or by a lack of oxygen to the brain, generally caused by a difficult birth (NINDS 2008). It was important to consider additional complications related to right sided brain damage to ensure an awareness of Jane’s level of functional ability be it; physically, cognitively or behaviourally. Those that may relate to Jane’s case are listed below in table one. Table one: How damage to the Right Hemisphere can affect function and the occupation of horse riding. Jane’s diagnosis would mean that she would need input from a Multi-Disciplinary Team (MDT). Given her age this would come from a community paediatric teams (CPT). The team will work closely with the children’s’ team in social services and primary care. The team will provide a range of assessments and interventions to young people and their families. In Jane’s MDT team there will be a range of different members such as: Physiotherapists, Paediatricians, Occupational Therapists, Social Workers, Speech and Language Therapists and Educational Psychologists (NHS 2012). According to the Disability Act Jane is entitled to an independent assessment of her individual needs. The act is designed to promote the participation of people with disabilities in society by supporting the provision of disability specific services (NCSE 2011). A standardised interview was used, this was to allow the OT staff to observe how Jane and her family interact with each other making it easier to; obtain information, identify strengths needs and goals as well as generate an intervention plan and enable goal scaling Due to Jane’s condition she would have already been known to social services and the MDT, as she had already received physiotherapy to aid with muscle stiffness and improve core strength. Therefore upon the OT department accepting Jane’s referral, an initial assessment was carried out in her home environment with mother and father present (An and Palisano 2013). Collaboration between professional ataff and Jane’s family is a vital component in family-centred services, this is considered best practice in early intervention and paediatric rehabilitation (An and Palisano 2013). Collaboration between the two parties is essential for setting meaningful and achievable goals for a child. Planning and implementing interventions must be able to fit within the context of family life. (An and Palisano 2013) The following strengths and weaknesses were identified during the initial assessment. Table two: Jane’s strengths and limitations During the initial assessment Jane’s mother expressed concerns about her core strength and whether this would affect Jane’s ability to ride. In order to address these concerns a Sitting Assessment for Children with Neuromotor Dysfunction (SACND) assessment was completed this is a clinical instrument to assess static and dynamic postural control in sitting in children with neuromotor dysfunction’ (Reid 1995) This standardised assessment was used to ascertain how Jane’s CP affects her ability to sit comfortably and concentrate. This skill will be essential if Jane wants to be able to sit upon a horse comfortably and be able to concentrate for the entire session. The SACND measures quality of independent sitting ability across four areas: proximal stability, postural tone, postural alignment, and balance (Knox 2002). The assessment revealed that Jane has weak upper trunk control and so will be issued a specially adapted chair which will enable her to sit more comfortably and for longer periods of time compared to standard chair. After both assessments were completed an intervention plan was made with input from Jane, her family and the occupational therapist. Jane identified her long term goal of horse riding and to achieve this long term goal, four short term aims were set to serve as recovery milestones (Duncan 2011). Table three: Jane’s long term aim and short term goals. Occupational therapists are not required to use a specific functional outcome assessment tool in the selection of their assessments. When a professional is selecting an assessment, they must rely on their clinical and professional judgment (Asher 2007). Therapists need to reflect on what it is that they intend to achieve with the assessment, and if this is managed the assessment can be classed as a success. One way of evaluating an assessment is to look at the performance of patients on an individual assessment task (Steultjens 2005). And will be able to question how well did the assessment relate to the goal setting and objectives for the patient (Duncan 2011). As part of the Model of Human Occupation horse riding will play a central part in Jane’s habituation. Not only will this establish a routine, it can be something that Jane can take pride in (Kielhofner and Forsyth 2011). Riding will help Jane build upon her self-confidence, having that natural trusting relationship with a horse that shows no judgment and does not understand that she is different (Horseback UK). The major concern that Jane’s mother presents is the worry that she will not be able to keep up with the physical requirements of riding and that this will dishearten Jane’s enthusiasm. This concern will be tackled in goal number four. Once Jane and her family have a better understanding of hemiplegic cerebral palsy, the OT can begin discussing, through the use of pictures how this may affect her. If Jane has a basic understanding of her condition it will be easier for her to set more realistic goals with the OT as she will have a greater awareness of what she is able to do and may struggle with. This will reduced the likelihood becoming distressed when trying to achieve goals her agreed goals, this will hopefully reduce mum’s concerns about the intervention plan. Jane feels her parents do not allow her to do as much as she would like to be able to do for fear of hurting herself or become too tired. The OT decided to make to make Jane aware of what fatigue is and may feel like. This would hopefully encourage Jane to let her mum or dad know when she is feeling tired. With this information Jane’s parents can keep a fatigue diary with Ellie. This will provide the OT with some information regarding when Jane feels most tired and how this impacts on her occupations. This can then be discussed with Jane’s parents and the RDA and suitable arrangements can be made regarding fatigue management as to when would be the most appreciate time for Jane to have her riding lesson when she has the most energy. Once a pattern of fatigue can be established the OT staff will develop strategies to manage Jane’s fatigue. For example Jane should engage in an activity that she finds relaxing such as reading, colouring or watching television. This can be done after more strenuous activity or in the morning if Jane is known to have a busy afternoon full of physical activities such as a riding lesson. If Jane is able to vary her day with relaxing and more strenuous activities, she will be able to conserve energy for the more strenuous activity of riding and therefore last the full hour lesson. This form of intervention uses the Compensatory Approach. The principle behind this approach is adapting to and compensating for a dysfunction rather than just treating the cause of the problem. Which in this is Jane’s cerebral palsy and her left sided weakness there is more of an emphasis on treating the symptoms (Feaver and Edmans 2006). Additionally, the Compensatory Approach may allow Jane to be able to regain a degree of her independence by compensating where the main cause cannot be treated. In Jane’s case this is managing and compensating on her weakness and fatigue, and therefore allowing her to conserve energy in order to complete a riding lesson (Addy 2006). The social approach recognises Jane as a social being who is easily influenced by the people around her. Therefore by using Jane’s whole family in her therapy and fatigue management, the professionals are integrating Jane’s social environment into her therapy (Polglase and Treseder 2012). Both interventions also reveal the perception of Jane by her social circle, thereby mitigating Jane’s fear about her social circle (Polglase and Treseder 2012). Jane has always said that Jane feels her parents do not allow her to do as much as she would like to be able to do for fear of hurting herself or become too tired. The treatment will require Jane to trust her parents and tell them when she is tired instead of retreating from her social circle (Martin 1998). In order to determine if Jane’s intervention has been a success we first evaluate it. Evaluation a professionals practice is one of the most important elements in occupational therapy; without it, the value of their intervention diminishes (Lawcett 2007). Evaluation is important as in theory it enables the OT and the client to see if intervention is affective. However it is vital that the client is willing to be part of the evaluation process, because if they are not this could present an incorrect evaluation of effectiveness of treatment (Lawcett 2007). There are four main was a professional can evaluate their intervention process these are; Using up to date outcome measures. Using valid and reliable evidence based outcome measures. Evaluate from view point of the service user Evaluate throughout therapy process, at end of intervention (Lawcett 2007). The success of Jane’s intervention plans can be evaluated by the ‘Goal Attainment Scale’(GAS) (King’s College London [no date]). The GAS is a measurement technique which consist of individualising a person’s outcome indicators (Turner-Stokes 2009). In order to evaluate the intervention the professional must first construct a list of thorough and complete outcome measures, which will then be given a numerical value to determine the success of the intervention (Kiresuk and Sherman 1968; Purkiss et al. 2013). Jane’s goals were based on a realistic forecast of her progress (May-Benson 2012) Jane’s performance was scaled into five levels, these reflected her actual performance in comparison to her expected outcomes (Kiresuk et al. 1994). A score like this was recorded for each weekly session over the course of a month and a total was tallied at the end, scoring the intervention with a numerical value. The professional knew it would be vital to give Jane and her control in her treatment in order to motivate an improvement (Turner-Stokes 2009), hence it was decided that the GAS goals would be discussed at the end of the session, showing a level of improvement (King et al. 1999) instead of recording it as s pass, fail assessment (Turner-Stokes 2009).
